GENERAL BOOKING TERMS AND CONDITIONS
The present General Reservation Conditions (hereinafter General Conditions) will regulate the commercial relationship arising between MASIA LA MOTA SLU and the user or client for bookings made through the forms MASIA LA MOTA SLU makes available on its website [www.masialamota.com](http://www.masialamota.com)
Booking through the MASIA LA MOTA SLU websites implies the express acceptance by the client or user of these conditions, as well as of the terms of use established for browsing the pages owned by MASIA LA MOTA SLU.
These conditions will apply without prejudice to the application of the relevant legal rules on the subject that may apply in each case.
The General Conditions of Contract regulate the distance selling relationship between MASIA LA MOTA SLU and the user or client, in accordance with legal provisions, in particular Law 7/1998 of 13 April on General Contract Conditions, Law 3/2014 of 27 March which amended the revised text of the General Law for the Defence of Consumers and Users, current regulations on the Protection of Personal Data, Law 7/1996 of 15 January on Retail Trade Organisation, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
MASIA LA MOTA SLU reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made through its websites, by any legally admissible means, and shall be binding for as long as they are published on the web and until replaced by valid subsequent modifications. However, MASIA LA MOTA SLU reserves the right to apply, in certain cases, Particular Conditions of Contract with preference over these General Conditions when it deems appropriate, announcing them in due time and form.
Pre-booking information
MASIA LA MOTA SLU informs that the booking procedure through its websites is detailed in the corresponding section for the formalisation of the booking. Likewise, MASIA LA MOTA SLU informs that the user can access the terms of use available on the same website.
By booking with MASIA LA MOTA SLU through its website, the user or client expressly declares to know, understand, and accept said terms of use and the General Conditions. Similarly, the user declares to be of legal age and to have the necessary legal capacity to access the MASIA LA MOTA SLU websites and to contract through them. The user is responsible for treating the identity and password obtained in the client registration as confidential and responsible, and may not transfer them to another.
Once the booking has been made, the user will see the booking confirmation on the screen and may print it as proof of the booking made. The booking confirmation and booking receipt (printed by the user) shall not be valid as an invoice.
Services and additional conditions
MASIA LA MOTA SLU informs that Check-In is from 14:00 and Check-Out before 12:00, with the option to extend departure until 14:00 subject to availability.
Children policy: MASIA LA MOTA SLU is not recommended for children under 10 years old.
Pets policy: MASIA LA MOTA SLU does not accept pets.
Reservation process
Offer of bookings and price reference
In compliance with current regulations and, in particular, Law 34/2002 on Information Society Services and Electronic Commerce, MASIA LA MOTA SLU provides in the relevant section for booking formalisation information on all possible bookings, their characteristics, and prices. However, MASIA LA MOTA SLU reserves the right to withdraw, replace, or change offers made to clients through its website by simply changing its content. Thus, the products and/or services offered at any given time on the MASIA LA MOTA SLU website shall be governed by the General Conditions in force in each case. Likewise, the company may cease to offer access to the aforementioned products and/or services at any time without prior notice.
Price indication
Each possible booking offered will indicate its price and whether VAT or any other applicable tax is included. The prices displayed on screen will be valid at all times except for typographical errors. If the price is different for the above reason, MASIA LA MOTA SLU will inform the client by e-mail before charging for the booking.
Availability
The availability of the offers made by MASIA LA MOTA SLU through its website may vary depending on customer demand. Although MASIA LA MOTA SLU updates the database periodically, the booking requested by the customer may be fully booked at that time. In such a case, MASIA LA MOTA SLU will send an email to the customer informing them of the unavailability of the offer.
MASIA LA MOTA SLU informs that for the Moors and Christians festival and New Year’s Eve a minimum stay of two nights is required.
Payment methods
MASIA LA MOTA SLU requests credit card details of the booking holder when making reservations through its website, to guarantee the booking. The establishment does not charge your credit card at the time of booking; it is used only as a guarantee. The establishment reserves the right to check the validity of the credit card prior to the client’s arrival. The corresponding invoice will be settled directly at the establishment, either in cash, by credit card, or by any other method accepted by the establishment.
Booking cancellation
If cancellation is made more than 14 days in advance, the establishment will not charge. If cancellation is made less than 14 days in advance, the establishment may charge 100% of the first night to the credit card provided.
For hotel-exclusive use, a deposit of 35% of the stay is required. If the reservation is cancelled less than 60 days prior to arrival, the 35% deposit will be refunded. If the reservation is cancelled less than 40 days prior, the hotel must be paid 100% of the booking.
Group cancellation: For reservations of 4 or more rooms, a deposit of 25% of the total booking is required, by bank transfer or credit card. Cancelling such a booking within 7 days before arrival will result in the total loss of the deposit.
Withdrawal
According to Article 103 of Law 3/2014 of 27 March amending the revised text of the General Law for the Defence of Consumers and Users, the supply of services or goods made to consumer specifications or clearly personalised, or which by their nature cannot be returned or may deteriorate or expire quickly, are exempt from the right of withdrawal.
In this sense, we inform you that bookings are exempt from the right of withdrawal.
DATA PROTECTION
In accordance with current regulations on the Protection of Personal Data, we inform you that your data will be incorporated into the processing system owned by MASIA LA MOTA SLU with CIF B54372099 and registered office at CRTA DE LA FONT ROJA KMT 5 03801, ALCOY (ALICANTE), for the purpose of facilitating, expediting, and fulfilling the commitments established between both parties. In compliance with current regulations, MASIA LA MOTA SLU informs you that the data will be kept for the strictly necessary period to comply with the aforementioned provisions.
We inform you that the processing of your data is legitimised by your consent and/or the contractual relationship we maintain with you.
MASIA LA MOTA SLU informs you that it will process the data lawfully, fairly, transparently, adequately, pertinently, in a limited manner, accurately, and in an up-to-date fashion. For this reason, MASIA LA MOTA SLU undertakes to adopt all reasonable measures to ensure that such data are deleted or rectified without delay when inaccurate.

You may contact the competent Supervisory Authority to file any complaint you deem appropriate.
APPLICABLE LAW AND JURISDICTION
MASIA LA MOTA SLU also reserves the right to bring any civil or criminal actions it deems appropriate for the improper use of its website and contents or for non-compliance with these conditions.
The relationship between the user and the provider shall be governed by the current regulations applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. MASIA LA MOTA SLU has its registered office in ALICANTE, Spain.
